Terms of Service — Homeowners

These Terms of Service ("Terms") govern your use of the PoweredNZ website at powerednz.com (the "Platform") as a homeowner or visitor. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

PoweredNZ Limited ("PoweredNZ," "we," "us," or "our") operates an online directory that connects New Zealand homeowners ("you" or "Homeowner") with energy-upgrade service providers ("Installers").


1. Acceptance of Terms

1.1 Agreement

By browsing the Platform, submitting a quote request, leaving a review, or using any of our tools or calculators, you agree to these Terms. You do not need to create an account to use most features of the Platform.

1.2 Related policies

These Terms should be read together with our Privacy Policy, Cookie Policy, and Review Policy, each of which is incorporated by reference.

1.3 Changes to these Terms

We may update these Terms from time to time. When we do, we will update the version number and date at the top of this page. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.

1.4 Age requirement

You must be at least 16 years of age to use the Platform. If you are under 18, you represent that you have the consent of a parent or guardian to use the Platform and submit personal information.


2. Description of Service

2.1 What PoweredNZ is

PoweredNZ is a directory and information service. We help New Zealand homeowners find and compare energy-upgrade installers across six categories: heat pumps, solar panels, EV chargers, insulation, ventilation, and hot water heat pumps. The Platform provides installer listings, assessment tools, pricing guides, educational content, and a quote request system.

2.2 What PoweredNZ is not

PoweredNZ does not perform installations, provide professional advice, employ or subcontract the Installers listed on the Platform, or guarantee the quality, pricing, timeliness, or outcome of any work performed by an Installer. Any contract for work is between you and the Installer directly. We are not a party to that contract.

2.3 Affiliate disclosure

Some Installers on the Platform pay for enhanced visibility (Pro and Featured listings). These paid placements are clearly marked. PoweredNZ may also receive referral fees from some Installers. Paid placements and referral arrangements do not constitute an endorsement or recommendation by PoweredNZ.


3. Quote Requests

3.1 How quote requests work

When you submit a quote request, you provide your name, email address, phone number, and project details. This information is shared with up to three Installers matched to your request based on your location and the type of work you need. Installers may then contact you directly to discuss your project and provide a quote.

3.2 No obligation

Submitting a quote request does not obligate you to accept any quote, hire any Installer, or proceed with any work. It is entirely your decision whether to engage an Installer.

3.3 Consent

Before your information is shared with Installers, you will be asked to provide explicit consent. The exact consent wording is recorded and timestamped. You may withdraw your consent at any time by contacting support@powerednz.com or using the self-service data portal at powerednz.com/my-data. Upon withdrawal, we will notify the relevant Installers and your data will be marked for deletion.

3.4 Data retention

Your quote request data is retained for 365 days from the date of submission, after which it is eligible for deletion. For full details, see our Privacy Policy.


4. Assessment Tools and Calculators

4.1 General guidance only

The Platform may include tools and calculators that help you estimate costs, compare options, or assess your home's energy needs. These tools provide general guidance only and do not constitute professional advice.

4.2 No guarantee of accuracy

Results are estimates based on the information you provide, community-sourced data, and general assumptions. They may not reflect your actual situation, local conditions, or current market rates. Always consult a qualified professional and obtain multiple written quotes before making decisions about home energy upgrades.

4.3 Pricing information

Prices displayed on the Platform are community-sourced estimates and may not reflect current market rates. Actual costs vary based on your property, the equipment chosen, and the Installer you engage. PoweredNZ does not guarantee any pricing information displayed on the Platform.


5. Reviews

5.1 Leaving reviews

You may leave a review for an Installer you have engaged through the Platform or have genuine experience with. Reviews must comply with our Review Policy. You must verify your email address before your review can be published.

5.2 Moderation

All reviews are moderated before publication. Reviews are held for up to 24 hours for review before going live. We reserve the right to remove reviews that violate our Review Policy at any time.

5.3 Licence

By posting a review, you grant PoweredNZ a non-exclusive, royalty-free, perpetual, worldwide licence to display, reproduce, and distribute your review on the Platform and in connection with promoting the Platform. You retain ownership of your review content.

5.4 Accuracy

You represent that your reviews are based on genuine personal experience, are truthful, and do not contain defamatory, misleading, or prohibited content as defined in our Review Policy.


6. User Conduct

You agree not to:

  • submit false, misleading, or fraudulent information in quote requests or reviews;
  • impersonate another person or entity;
  • use the Platform for any unlawful purpose;
  • attempt to gain unauthorised access to any part of the Platform;
  • use automated tools (bots, scrapers, crawlers) to access or extract data from the Platform without our written consent;
  • interfere with or disrupt the operation of the Platform; or
  • upload or transmit any content that contains viruses, malware, or other harmful code.

7. Intellectual Property

7.1 Platform content

All intellectual property in the Platform — including its design, code, branding, logos, guides, educational content, and compilation of data — is owned by or licensed to PoweredNZ. You may not reproduce, modify, or distribute Platform content without our prior written consent, except for personal, non-commercial use (such as saving a guide for your own reference).

7.2 User content

You retain ownership of any content you submit to the Platform, including reviews and quote request details. By submitting content, you grant us the licences described in Section 5.3 (for reviews) and consent to the use of your quote request data as described in Section 3 and our Privacy Policy.


8. Limitation of Liability

8.1 No liability for Installer work

PoweredNZ is not liable for the quality, safety, legality, timeliness, or outcome of any work performed by an Installer you find through the Platform. Any dispute about work quality, pricing, or conduct is between you and the Installer.

8.2 No liability for information accuracy

While we take reasonable steps to ensure the information on the Platform is accurate and up to date, we do not warrant that any information — including Installer listings, credentials, reviews, pricing estimates, or tool outputs — is complete, accurate, or current.

8.3 Liability cap

To the maximum extent permitted by the Contract and Commercial Law Act 2017 (NZ) and the Consumer Guarantees Act 1993 (NZ), our total aggregate liability to you for any claim arising out of or in connection with your use of the Platform is limited to NZD $100. Nothing in these Terms limits or excludes liability that cannot be limited or excluded under New Zealand law, including liability for fraud or wilful misconduct.

8.4 Exclusion of indirect loss

To the maximum extent permitted by law, we are not liable for any indirect, incidental, consequential, special, or exemplary damages, including loss of profits, loss of data, or damage to reputation.

8.5 Availability

We do not warrant that the Platform will be available without interruption, that it will be error-free, or that defects will be corrected. We may suspend access for maintenance at any time.


9. Disputes with Installers

PoweredNZ is not a party to any agreement between you and an Installer. If you have a dispute with an Installer about work quality, pricing, or conduct, you should attempt to resolve it directly with the Installer. If the dispute relates to licensed trade work (electrical, plumbing, gasfitting, building), you may also contact the relevant New Zealand regulatory body or the Ministry of Business, Innovation and Employment (MBIE).

If you believe an Installer has engaged in misleading or deceptive conduct, you may report it to us at support@powerednz.com and to the Commerce Commission at comcom.govt.nz.


10. Governing Law and Disputes

10.1 Governing law

These Terms are governed by, and construed in accordance with, the laws of New Zealand.

10.2 Jurisdiction

The courts of New Zealand have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.

10.3 Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.
